An open letter to CBC.ca spokesman Chris Ball

Hi Chris,

Thanks for trying to clear this up. It’s good to know that appropriate sharing of CBC.ca content is welcomed, but I must admit that I’m still confused as to what CBC.ca deems “appropriate”.

I’d love it if you could clarify the following:

•You write that CBC.ca “welcome(s) appropriate use of our content in blog posts, social networks and other online media.” Yet the CBC.ca Permissions FAQ you cite states that “Any content found on CBC.ca can only be reused elsewhere with the permission of CBC”. Does this mean that anything other than a link requires either written permission or iCopyright licensing?

•You write that if users want to “excerpt” CBC.ca stories on their blogs, they can. Yet the iCopyright heading on CBC.ca reads: “New licensing option: POST all or part of this article on a web site, intranet or blog.” This link leads to a costly pay option. So did you mean to say “they can- if they buy a license”? Or is “excerpting” allowed without one? And what exactly constitutes an excerpt?

•The CBC.ca Permissions FAQ explicitly forbids students from using CBC video in classroom presentations (unless they buy a license). It also prohibits any translation or adaptation of CBC.ca articles. It also demands that Canadian teachers seek written permission before using a CBC.ca article on private class websites. Beyond these educational uses, the posting of pictures, graphs, and the CBC logo itself all seem to require either written permission or an expensive and temporary license. Finally, the CBC.ca FAQ encourages Canadians to *report each other* for “misuse” of CBC copyright.

My question: given that these demands and requirements are ignored daily by thousands of Canadians freely sharing CBC content, and since these demands and requirements are wildly out of step with the culture and language of the Internet itself, does the CBC actually intend to enforce these rules through lawsuits targeting teachers, students, non-profit organizations, and individual Canadians, who are expected to aid the CBC in this pursuit by informing on each other?

•If not, can we assume that “iCopyright” is just a means to generate revenue from those who choose to honor it?

•Who would that be?

•How much revenue could the CBC possibly be anticipating from this, and is it worth the very real possibility that it will frighten and discourage Canadians from using CBC content at all?

Again, I do appreciate your willingness to openly engage with the public's concern over this and I trust you’ll take the opportunity to answer these questions clearly and in detail.

Note of appreciation

Thanks for bringing this to our attention Jesse. I agree with the previous comment that as the CBC is owned, and still largely funded, by Canadians that at least this is one place where content should be free to be used by Canadians as well need it. I am more than happy to give the CBC some extra dollars when tax time comes... it surely needs it, but it really shouldn't be charging us a second time for content that we paid to generate.

This is surely not a path to go down if the CBC is trying to keep up its user base.
